RULE 104 - ARRESTS AND NOTICES TO APPEAR

Pursuant to the provisions of Penal Code Section 836.5, the Air Pollution Control Officer and his deputies are authorized to arrest without a warrant and issue written notices to appear whenever they have reasonable cause to believe that the person to be arrested has committed a misdemeanor in their presence which is a violation of a rule or regulation of the Monterey Bay Unified Air Pollution Control District or a violation of a section of Chapter 2 of Division 20 or Chapter 3.5 of Part 1 of Division 26 of the Health and Safety Code of the State of California, or any provision of the Vehicle Code relating to the emission or control of air contaminants.
